RAWLINGS TO GET A REPRIEVE
It Begins to Look Like There Will Be Another Delay
Remittitur from the U.S. Supreme Court Will Bring the Case Back to the Lower Court and the Men Will Have to be Sentenced Again — Will Necessitate a Delay
(From Thursday’s Daily)
There is a bare probability that there will be another reprieve for J.G. Rawlings and his sons, which means that the hanging will not take place on May 4th.
The United States Supreme Court will have to hand down a remittitur in the case to the lower court, and this will have to be made the judgment of that court, which will necessitate sentencing the prisoners again. Or, at least, that is the way we understand it.
Attorney Cooper has stated that he has two other cards up his sleeve, and he expects to play them pretty soon. One of them is an appeal to the pardoning board, and the other is “something else” as he expresses it. This “something else” is said to be a plea of insanity for the old man. If the remittitur from the Supreme Court were received now, it is doubtful if it could be made the judgment of the other court before the day set for hanging.
Taken altogether, it looks now as if J.G. Rawlings will have to suffer the disappointment of another lease despite the fact that he says he is tired of having the execution postponed.
Mrs. Rawlings and her brother Walter Jowers came over from Coffee County this morning and are looking after the petition to the pardon board to commute the sentence of the boys to life imprisonment.
